Use of Software

Using our Software for commercial endeavors is entirely prohibited. Users are authorized to use the Software solely for personal enjoyment. Under no condition are Users permitted to employ their smarts-digital.com accounts for any purpose aside from entertainment-based gameplay. Attempts to alter, disassemble, decompile, or reverse-engineer the Software are strictly prohibited. Any implementation of automated systems, including robots, in association with the Software and Games is expressly forbidden. All gameplay actions within Fantasy Cricket must be executed manually by Users via the designated user interface within the Software.

Your Password, Your Responsibility

Once registration on our Website is complete, it becomes your sole obligation to maintain the confidentiality of your password. Refrain from disclosing your password to anyone, including friends and relatives. We accept no responsibility if another party accesses your account using your credentials.

Eligibility and Jurisdiction Policy

• Anyone intending to join the Contests must have a functional and valid email account.
• Only those who have successfully enrolled on smarts-digital.com and signed up for a Contest prior to the beginning of each round, as per the outlined rules, shall be deemed eligible to play and earn rewards.

Breach and Consequences

If you violate any Terms of Service, as proven by our internal assessment, or if your ongoing access to our Website is reasonably considered to be harmful to smarts-digital Fantasy Cricket, our Users, or the public interest, we reserve the right to take one or more of the following steps:

1. Restrict gameplay between users suspected of collusion or fraudulent behavior;
2. Irrevocably suspend your Website account;
3. Confiscate the funds in your account;
4. Seek compensation through legal channels and initiate civil proceedings for such violations, and/or pursue criminal charges if applicable under law.
5. Furthermore, in the event of a major breach, we reserve the right to permanently prohibit your future registration on the Website.

Any decision made by smarts-digital Management regarding consequences of a violation will be deemed final and obligatory. Any enforcement by the smarts-digital Fantasy Cricket platform is independent of any other legal or equitable recourse we may have.

Governing Law, Dispute Resolution and Jurisdiction

This Agreement will be fully governed, interpreted, and construed according to Indian law. All conflicts, grievances, and related matters will be subject to arbitration as per the Indian Arbitration and Conciliation Act, 1996.

Content

All Website content and materials, including but not limited to, details, visuals, trademarks, emblems, layouts, illustrations, text-based content, links, media clips, animations, games, and applications (collectively termed as “Content”), whether owned by smarts-digital or not, are safeguarded by relevant intellectual property laws. Moreover, all chat transcripts, messages, visuals, suggestions, and emails submitted by Users may be recorded and regarded as Content. smarts-digital Fantasy Cricket platform reserves the unrestricted right to utilize such material in any capacity.

Contest Formats

• smarts-digital Fantasy Cricket platform features two contest types: (1) Public Contests where Users can freely join and compete with others without restriction, and (2) Private Contests where entry is restricted to invited Users only. Rules laid out herein apply uniformly to both formats.
• Public Contests
  • In the Public Contest structure, smarts-digital may organize competitions comprising 2, 3, 5, 10, 100, or another predetermined number of Participants.
  • These Contests may be fee-based, with winners announced post-round.
  • Contests become active once the minimum required number of Participants is met. If fewer Participants enroll by the designated start time, the Contest will not proceed, and the entry fees will be refunded in full to each account.
  • In selected Contests marked “Confirmed Contests,” operation begins once the predetermined number of winners has been reached, even if not all participant slots are filled. Participants may continue to join until either (i) all slots are filled or (ii) the relevant rounds start—whichever happens first. If such Contests are not activated by round start time, fees will be fully reimbursed.

Private contest

• Private Contests allow Users to create their own Fantasy Cricket competitions (“Private Contests”) and invite other individuals—whether existing members or not (“Invited User”)—to build Teams and enter the Contests. Users may limit participation to a set number such as 2, 3, 5, or 10 Participants. The Contest creator will pay the entry fee, name the Contest, and automatically join it. A distinct code (Fantasy League Code) will be generated for this Contest and assigned to the creator's account. The creator may not alter any Contest rules or structure after creation, except to rename the Contest. smarts-digital will utilize the email addresses or Facebook usernames of Invited Users to send them invitations for registration and participation.
• To enter a Private Contest, an Invited User must enter the respective Contest Code and pay the fee. Once the number of Participants matches the predefined total, the Contest is activated and no further entries will be accepted. If the required number is not reached within 1 hour before the round starts, Participants may opt to convert it into a Public Contest to allow open participation. smarts-digital executes such conversions in a queued manner and does not guarantee the conversion will occur or that it will receive enough participants. If the required number is still not met at the start, the Contest remains inactive and all fees are refunded in full.
• Participation of Invited Users in Private Contests is conditional on meeting the predefined Participant count. smarts-digital Fantasy Cricket platform accepts no liability if an Invited User fails to participate due to any cause, including hardware failure, technical issues, or disqualification.

Indemnity

To the fullest extent legally permissible, and in exchange for access to our Services and Contests, you hereby commit to indemnify, defend, and hold us harmless (inclusive of all awards, litigation expenses, disbursements, and reasonable legal fees—including any direct or indirect losses, damages to reputation, or lost profits) against any allegations, lawsuits, taxes, penalties, interest, injuries, causes of action, demands, or rulings brought forth by any third party concerning:

1. Violation of intellectual property rights via any Content published by you on our Website;
2. Any defamatory, illegal, offensive, or harmful behavior by any player or misleading, unlawful, threatening, indecent, or inaccurate content originating from any user;
3. Improper or unauthorized use of your smarts-digital account in any fashion;
4. Connection issues, technological breakdowns, transmission errors, system malfunctions, data loss, denial of service attacks, or any digital interruptions during access or usage of our Website;
5. Unauthorized access to your account by any individual using your login credentials, regardless of your knowledge.

Governing Law and Jurisdiction

Our Terms of Service and Privacy Policy shall be interpreted following the legal statutes of India. All resulting legal matters will fall under the exclusive jurisdiction of civil courts located in New Delhi.

Refund Policy

All funds deposited and payments made on smarts-digital.com, including Contest entry fees, are considered final. All transactions are non-refundable. Nonetheless, recognizing the importance of user satisfaction, we will investigate any errors related to financial transactions on a case-by-case basis.

Should you find yourself dissatisfied with any deposit, acquisition, or fee remitted on smarts-digital, and believe an ‘Error’ has occurred in such transaction, kindly notify us within three (3) days from the transaction date. We will then review and resolve the issue at our sole discretion.

smarts-digital holds the authority to revoke any matches for any cause, whether explained or not, and will promptly refund all associated fees to every user involved.

Users are strictly prohibited by smarts-digital from entering any game rooms once the cricket match relevant to that game room (identified by the Series) has started.

Legality

• Engagement in skill-based games is lawful as such activities are exempt under Indian gambling laws, notably the Public Gambling Act of 1867. The Supreme Court of India, in judgments including State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. • By entering our Contests, Participants confirm and accept that they are engaged in a game governed by skill rather than luck.

Fantasy Score and Feeds

The smarts-digital Fantasy Cricket interface may acquire scoring data and other necessary inputs for calculating and compiling points from third-party vendors. If, on rare occasions, there arises an error in computing or aggregating scores, or in selecting winners due to incorrect or partial data from such third-party services, smarts-digital.com will strive to amend the issue before awarding prizes. Nonetheless, smarts-digital.com emphasizes that it depends on the correctness and entirety of data from third-party feeds and disclaims any guarantees regarding its accuracy. As such, it assumes no liability for miscalculations or erroneous winner selection resulting from flawed or incomplete feed data from third-party providers. Users agree to refrain from raising grievances or legal actions against smarts-digital in this context.

Regarding the Starting Line-up Feature: The intent behind displaying a player’s participation in the final lineup is solely informative, aiding users in team selection on smarts-digital. Though the indication is based on data relayed via feed providers and public info sources, users should verify through official or alternative credible sources. smarts-digital disclaims any responsibility should a player marked as ‘Playing’ subsequently not participate for any reason.

Bonuses: All Fantasy Cricket Bonus schemes and Promotional Offers (Instant Bonus, Friend Referral Bonus, Free Bonus, Earnings Bonus) presented on www.smarts-digital.com are governed by the following rules, which are binding upon all Users accepting a Bonus or Promotion:

Free Bonus: This type of bonus is initially credited to your Bonus Wallet and incrementally moves to your Balance Wallet as you participate in game rooms and pay the match fee. The release rate is 4% of the match fee per Fantasy Cricket room completed—regardless of win or loss.

All liabilities, damages, losses, and expenses incurred from using the smarts-digital platform, services, or content lie entirely with the User. smarts-digital does not bear responsibility for claims arising from the use of the Website or services provided therein.
   • smarts-digital disclaims any accountability for third-party IP infringement claims stemming from your possession and/or use of third-party intellectual property.

10. In event of conflict or disagreement, the judgment of smarts-digital Management will be considered final and obligatory.
